Will the HPM break the law to appoint another candidate to parliament so close to elections ?

Can the HPM confirm or deny if he will break the law to appoint another candidate to parliament? Section 64(3) of the constitution barred the appointment given that it’s less than 6 months to election. What will the HPM do?
